MINUTES OF RYDE TOWN COUNCIL’S COMMUNITY PLANNING COMMITTEE MEETING HELD ON TUESDAY, 28 JANUARY 2025 AT 7.00PM

PUBLIC QUESTION TIME


Q - A question was asked regarding the Enforcement Officers report, on why there was an absence of news on Vectis Hall in the section on “Upcoming Enforcement Issues”, as it was a prominent building of historic character but was now in a very poor condition. However, on page 10 of his report ( under Open Cases) the Enforcement Officer stated that he was in correspondence with the landowner of Vectis Hall (which is Ryde Town Council).


Is the reason therefore, for it not being mentioned in “Upcoming Enforcement Issues” section, due to it being that at the Finance and Community Resources Committee meeting on 21 January 2025, there was a Payments List dated 19/12/2024, outlining Christopher Scott Vectis Feasibility Study of £1500.00 for Vectis Hall and a Bank Reconciliation listed a payment to Christopher Scott on the same date of £1800.00 (including the VAT?). Could it therefore be confirmed if this was a deposit for the Feasibility Study, or full payment; and when would the Feasibility Study be brought into the public domain?


A - The Community Planning Officer stated that the reason why no enforcement action was being served on Ryde Town Council was because the Town Council was actively engaging with the Isle of Wight Councils Conservation Officer about the buildings future. Regarding the query around the payment to Christopher Scott, this would be answered via a written response.

Q - Regarding a recent media report on enforcement action being served upon the owner of Ryde Town Hall, which stated that "Ryde Town Council enforces urgent works for the preservation of Town Hall". A member of the public asked who was responsible for the press release and claimed that action taken by the owner was not due to enforcement but was a result of the owner being proactive and addressing the situation of the building himself.


A - The Community Planning Officer advised that Ryde Town Council did not release the update to the media outlet and was as surprised as anybody to learn of it. The Community Planning Officer contacted the media outlet to advise that any action taken did not involve Ryde Town Council. All operational work was the responsibility of the Isle of Wight Councils Enforcement Officer, who was also part funded by Ryde Town Council, for any enforcement work affecting Ryde.

Q - A question was asked about the Appley Shelter murals and whether any that fell within Puckpool would have any costs covered by Seaview and Nettlestone Parish Council.


A - The Chair advised that the applicant agreed to approach Seaview and Nettlestone Parish Council about making a contribution.

Q - Regarding the Town Board, a question was asked over whether the Board had engaged with the Committee regarding any possible plans for the Town?


A - It was noted that the Community Planning Committee had no direct input to the Town Board, but the incumbent Ryde Mayor was the Town Councils representative and would feed any ideas and comments beneficial for Ryde to the Board.

5/25 PUBLIC REALM APPLICATION – GRAFFITI BOARDS

An application from Community Murals IOW CIC regarding a project to provide a unique and engaging platform for local youth to explore their creativity, develop artistic skills, and express themselves in a positive, supervised environment, was considered.

Such a scheme would help to make Ryde Skate Park more attractive to users, encourage increased use and offer a constructive outlet for artistic expression. The boards would be left up at the park as working walls for those interested in street art to have a space for their creativity. Groups that would be involved in the project would be Carnival company CIC, Network Ryde and Ryde Aspire (via their Youth Contact).


The costs would be broken down into the following:


The carnival Company would contribute £500 towards the project. Community Murals IOW CIC have therefore requested the remaining £2,500 from Ryde Town Council, via the Public realm application.


Should the application be agreed it was noted that work would start in the Spring of 2025.


After a proposer, seconder and a vote via a show of hands, the following was:

THAT the Public Ream Application from Community Murals IOW CIC for a sum of £2,500 from Ryde Town Council, be agreed.

6/25 RATIFICATION OF OFFICER DELEGATED DECISIONS


Members were reminded that owing to the Christmas and New Year break, and the subsequent absence of any meeting, it was necessary for the Community Planning Officer and the Committees Co-ordinator to make decisions on any Planning Applications, in consultation with the Chair and the Vice Chair of the Committee. Members were therefore required to ratify for the record the decisions taken, as outlined in Paper C.

Following a proposal, seconder and a vote via a show of hands it was:

7/25 RATIFICATION OF DECISIONS TAKEN BY THE COMMITTEE VIA EMAIL CORRESPONDENCE

Owing to the previous scheduled meeting on 17 December 2025 not being quorate, members were requested to consider the following two items for decision, as outlined in Paper D and Paper E, which were taken via email correspondence:


  1. Murals for Seafront Shelters in Appley


    Members agreed via email the Public Realm Application for the installation of several murals to enhance sea wall shelters at a cost of £5,750 from the existing 2024-2025 Public Realm Budget.


  2. Community Planning Budget Allocation for 2025-2026


    Members agreed via email to recommend to all members of Full Council at its budget meeting on 4 February 2025 the following:


    1. That the Enforcement Officer continues to be funded by RTC for 2 days per week in 2025/2026 as in 2024/2025 (starting 1 June 2025).

    2. That the Community Planning Committee is to be funded with £18,000 for Public Realm Projects and £2,000 for Planning Administration.

Members were therefore required to ratify the two decisions for the record. Following a proposal, seconder and a vote via a show of hands it was: RESOLVED:

THAT the above three decisions taken by the Community Planning Committee via email correspondence on the week commencing 23 December 2024, be ratified.


8/25 MEMBERS QUESTION TIME


Cllr Ross asked if there had been any movement on Ryde Town Council acquiring the lease for Western Gardens? There had been some enquiries from various organisations who had expressed interest in utilising the land for events.


It was noted that there had been no recent discussions, but the area was looking somewhat neglected in recent times with the grass being run-down and the gardens being a magnate for anti-social behaviour. The Town Council would be interested in looking at options to improve the area and a future Development Strategy Sub Committee (an internal body which sits under the Community Planning Committee), would discuss the matter at a future meeting.

11/25 CONSULTATION FOR PLANNING - LOCAL LIST REQUIREMENTS


Members considered the latest consultation around the list of local requirements for the validation of all planning related applications.

The Committee noted that The Isle of Wight Council, as the Local Planning Authority (LPA), is required to review its list of local requirements for the validation of all planning related applications on a regular basis. This usually happens every five years or so.

The latest list intended to make the rules easier to understand the process, making everyone know what to include in their applications and therefore help make the process faster and better for everyone, including applicants, agents, architects, the public, and local Councils.

A significant change was around Biodiversity Net Gain (BNG) and the requirement for some projects to show that they would help preserve nature.


The consultation would be for eight weeks, beginning on 10 December 2024 and ending on 4 February 2025.

Members broadly agreed to acknowledge the proposed list of requirements with nothing further to add to them. It was however noted that such requirements should be monitored well and enforcement served should there be any non-compliance.


12/25 DRAFT ISLE OF WIGHT LOCAL NATURE RECOVERY STRATEGY (LNRS) – CONSULTATION.


Members were advised that In December 2024, Defra and Natural England approved the draft LNRS for the Isle of Wight. The next step would be to hold a period of public consultation before the Isle of Wight Council was asked to approve the final version.


The consultation period would end on 14 February 2025.


The strategy recognised the critical importance of protecting the biological integrity of the Island, and the quality and value of its natural world. By affirming the establishment of the Isle of Wight UNESCO1 World Biosphere Reserve as the overall context for the LNRS, it acknowledged the urgent need for integrated and widespread action against the impacts of climate change, biodiversity loss and health and well- being inequality.


The Committee agreed that as there were different and potentially complex issues in certain wards, it would be better served to send every Ryde Town Councillor the link to the consultation in order to highlight areas that could be focussed on.


13/25 ENFORCEMENT UPDATE


The committee were provided an update which included the following:



Regarding the report originally published for the (inquorate) meeting on 17 December 2024, it was noted that whilst all the work carried out on various buildings and properties has proving to be fruitful, large properties of a prominent nature, such as the former Royal York Hotel and which was always the subject of public concern, should remain a priority case.

PUBLIC QUESTION TIME


Q - A question was asked regarding the condition of the railings on the eastern side of the Pavillion building which had become detached and rusty.


A - The Community Planning Officer stated that the Isle of Wight Council were aware and would be taking the necessary action to ensure the railings would be suitably repaired and refurbished.


Q - A question was asked regarding the Bridging the Gap: Youth, Art and Community Graffiti Project (which was agreed at the previous meeting) and whether the amount of money agreed covered the amount of those involved in the project?


A - The Community Planning Officer advised that the project was agreed at the meeting on 28 January 2025 for the amount requested and there would be no further costs allocated by Ryde Town Council.


It was also noted that the Public Realm Budget was not the same as a town council grant as it was an allocation to the Community Planning Committee specifically for Ryde’s areas of special public interest.

19/25 MEMBERS QUESTION TIME


Cllr Ross asked if the Isle of Wight Council had been made aware of the poor condition of the Eastern Gardens Archway and was there any plans to bring them back into a good condition?


The Community Planning Officer advised that the Isle of Wight Council were aware and that they were planning to take the Archway down as it represented a safety hazard. Ryde Town Council had spoken with the relevant IWC Officers and requested strongly that the Archway should be put back in place once they had been made safe and presentable.


20/25 PLANNING APPLICATIONS


The following planning applications were considered by the Committee:


  1. Application No: 25/00116/HOU

    Parish(es): Ryde Ward(s): Ryde North West Location: 23 John Street, Ryde, PO33 2PY

    Proposal: Demolition of utility room; proposed alterations to include replacement windows and doors; replacement and extension of boundary wall to front to create enclosed amenity area; creation of amenity space at rear; proposed roof terrace on 2nd floor.

    This application was for the addition of a balcony which would overlook John Street, down Victoria Street and the immediate surrounding area. In addition, the application included the replacement of existing windows with new heritage type UPVC windows and the creation a small wall to separate pedestrian entry from off road parking.


    Members believed it would be churlish to object to the UPVC window frames owing to there being others already in place on the building. They also agreed that the balcony posed no overlooking issues to neighbouring properties.

    However, the committee did believe that a condition should be put in place regarding the proposed parking space which stipulates that it consists of a permeable surface to assist surface water drainage.


    After a proposer, seconder and a vote via a show of hands, the following was:

Proposal: Proposed replacement windows on north, south and west elevations.


This proposal was for the installation of new windows for the entire building (front and side facing). However, there was some confusion as to the make-up of the frames as the Design and Access Statement stated that the front (south) elevation was being replaced with timber windows, but the application plans showed all windows were being fitted with UPVC frames, which would pose concerns for a property situated within a Conservation Area. The existing frames had been made of timber.


Members agreed that they were unable to support the application owing to the conflicting information around the makeup of the window frames in the plans and the Design and Access Statement.

22/25 PRE PLANNING APPLICATION


Members were asked to note that a potential planning (and possibly licencing) application would be submitted for the Beach House (within Eastern Gardens along the sea walkway) where the applicant was seeking the views of the Committee on a proposal to install a timber frame cover to provide an all-weather shelter for customers whilst consuming their food and drink.


The Committee agreed that it was difficult to form a proper view of the proposals without seeing any formal plans which would provide a sense of scale and proportion. They did however believe that any covering must prevent any tables and chair from being sited outside the permitted licensing area and create an obstruction to passing members of the public.


The Community Planning Officer therefore agreed to write to the applicant to gain further information on the size of the proposed structure and advise them of the committees comments on the licenced area.


23/25 ENFORCEMENT UPDATE


The committee were provided an update which included the following:



It was noted that the Enforcement Officers first year of work would conclude in June 2025. Following this and after being agreed at Ryde Town Councils Budget meeting on 4 February 2025, the term of office would be extended for a further year, but on a reduced two day a week basis. The main focus of activity would then be around larger more high profile cases such as the former Royal York Hotel.


24/25 URGENT LATE ITEM OF BUSINESS - PUBLIC REALM APPLICATION FOR


Members were requested to consider the following application from the Play Lane Millennium Green Trust:

Millennium Green Path Redressing and Bridge/Walkway Renewal


Play Lane Millennium Green was established as one of a number of national breathing spaces under the Countryside Initiative to mark the Millennium.


It was now a well-established wild woodland, butterfly meadow and pond area with walkways and pathways and some informal seating and was a valued resource maintained by a small group of trustees for the benefit of the community.


The Green was used daily by children and young people, dog walkers, families and others. However, over time some degradation of pathways and bridges had occurred, which posed increasing health and safety issues.


The application was for hard landscaping remediation and replacement at an initial cost of £500 plus a further £1,000 for ongoing path maintenance over the ensuing five years.


After a proposer, seconder and a vote via a show of hands, the following was:

RESOLVED:

THAT the Public Realm Application from the Play Lane Millennium Green Trust for £1,500 be agreed.
